5. Property Accounts and Authorized Access

The property-management portion of the Platform is a restricted-access system.

The general public cannot create a property-management account simply by registering through the Platform.

Accounts may be created, approved, issued, or authorized by Emergency Towing for properties and representatives that we determine are authorized to use the Platform.

Each user is responsible for maintaining the confidentiality of his or her login credentials.

Submitting information through the Platform does not automatically establish a towing relationship with Emergency Towing.

A property may submit a request asking Emergency Towing to provide towing or related services. Submission of such a request does not require Emergency Towing to accept the property or provide services.

Unless otherwise permitted by applicable law, towing services requiring authorization through a property relationship will not be provided until the applicable service agreement has been accepted and the property and its authorized representatives have been approved by Emergency Towing.

7. Vehicle and Towing Information

Because Emergency Towing provides consensual and nonconsensual towing and storage services, information concerning vehicles and towing events may be collected or maintained when reasonably necessary to perform services, document towing activity, comply with applicable law, respond to inquiries, or protect the legal rights of Emergency Towing and its customers.

Such information may include photographs, vehicle descriptions, license plate information, VIN information when appropriate, location information, towing authorization information, dates and times, reported violations, and related records.

8. Electronic Signatures and Records

The Platform may allow authorized persons to review and electronically sign agreements and other records.

We may maintain electronic records relating to the signing process, including the document executed, signer's name, date and time, electronic signature, account information, and other information reasonably necessary to authenticate or document the transaction.

9. Data Security

Emergency Towing uses reasonable administrative, technical, and organizational measures designed to protect information maintained through the Platform against unauthorized access, acquisition, destruction, use, modification, or disclosure.

However, no website, computer system, electronic transmission, or data-storage system can be guaranteed to be completely secure. Accordingly, we cannot guarantee absolute security.

Requests to delete information will be evaluated subject to our legal, regulatory, contractual, operational, litigation, insurance, and recordkeeping obligations.

Certain towing, authorization, contractual, transaction, or legal records may not be deleted merely upon request when Emergency Towing has a legitimate or legal reason to retain them.
